Just prior to the Covid pandemic, Mr. Landau was victorious in one of the most notable cases in the Southern District of Florida in the past decade. In what the court called “bet-the-case” litigation, Mr. Landau successfully prosecuted a fraudulent transfer claim which resulted in the avoidance of a $40 million dollar mortgage on the Palm House Hotel, a boutique hotel located on Palm Beach Island. Mr. Landau subsequently represented the receiver in the sale of the hotel to a London based development firm. The sale proceeds ultimately funded a Chapter 11 plan which repaid over $20 million to defrauded EB-5 investors. Mr. Landau successfully defended two appeals in this case all the way to the U.S. Supreme Court.
